Incident Date: 9-20-2007  Powder Springs, Georgia

Synopsis:

Several weeks prior to incident date Brandon Miller and Stephan Davila met with John Chisholm to purchase marijuana. As soon as Brandon Miller took possession of the marijuana he took off without paying.  No weapon involved-just a “rip-off”.

On 9-20-07 Stephan Davila is with Brandon Miller and Camron Hubbard at a Racetrac Gas Station in Powder Springs when they happen to see the defendant’s John Chisholm and Kendrick Taliferro.  Words are exchanged and Brandon Miller apologized.  The victims then left the area and the defendant’s followed.  When the victims got to the home of a friend they stopped.  The defendant’s drove right up to the victim’s car and begin demanding their money and Chisholm produced a 9mm handgun.  Chisholm fired two shots at the vehicle, Stephan Davila had been in the back seat and was the last one out of the vehicle.  He immediately took cover behind the vehicle, but a bullet went through the car out the driver’s door and struck Davila in the face causing extensive damage.  After firing the shots the defendant’s left the scene.

Within moments police located the defendant’s on Macedonia Road, Powder Springs and initiated a traffic stop.  Shortly afterwards positive identification was made my two of the victims and another witness.  Also located in the defendant’s vehicle was approximately 7 ozs. of marijuana and many small empty Ziploc bags, all consistent with an intent to distribute.

Jury selection ended on 3-27-09.  Immediately following John Chisholm (shooter) pled guilty to all charges and was sentenced to 17 yrs. Prison followed by 20 yrs. Probation

Kendrick Taliferro proceeded with a trial and was found guilty of 3 cts. Aggravated assault and 3 cts. Poss. of firearm during commission of crime
